Assumption of Risk, Waiver of Liability & Indemnity


Access to AITL docks, ramps, and parking areas is entirely at the renter’s own risk.
AITL is not responsible for loss, damage, personal injury, or death resulting from the use of dock space.

Renter acknowledges that AITL does not require proof of insurance to rent dock space.

By signing this agreement, the renter understands and agrees that docking a vessel at this facility is done entirely at their own risk.

Artisan Inn & Twine Loft Ltd., its owners, employees, contractors, agents, and affiliates shall not be liable for any loss, damage, personal injury, or death, whether caused by weather, vandalism, theft, accident, or any other cause.


The dock renter shall be fully liable for any damage caused by their vessel, directly or indirectly, to the dock, other vessels, or third-party property.
Renter agrees to defend, indemnify, and hold harmless Artisan Inn & Twine Loft Ltd., including its owners, employees, contractors, agents, and affiliates, from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

Damage caused by the renter’s vessel;

The use of dock space by the renter or their guests;

Any breach of this agreement;

Any personal injury or death arising from use of the facilities.


This indemnification survives the expiration or termination of this agreement and includes claims resulting from the alleged negligence of AITL, to the fullest extent permitted by law.


Renter is responsible for the conduct and safety of any guests and agrees that this agreement applies equally to their actions.

Jurisdiction
This agreement shall be governed by the laws of the Province of Newfoundland and Labrador. Any legal disputes shall be resolved in the courts located in Clarenville, NL.

Definitions

AITL: Refers to Artisan Inn & Twine Loft Ltd., including its owners, employees, contractors, agents, and affiliates.

Dock Space: The specific location assigned to a renter for the mooring of their vessel.

Renter: The individual who has entered into this agreement with AITL, either for a fee or with permission from AITL to do so without charge and is responsible for the vessel during the rental term.

Vessel: The boat or watercraft identified in this agreement, including all attached equipment, dinghies, or gear.

Guests: Any individuals permitted by the renter to access the dock or vessel during the rental period.

Relocation: Any movement of a vessel by AITL or its representatives, typically due to safety concerns or emergencies.

Rental Period: The start and end dates for which dock space is rented under this agreement.

Indemnify: A legal obligation for the renter to cover costs, damages, or liabilities incurred by AITL due to the renter's or their guests’ actions.

Hold Harmless: A promise by the renter not to hold AITL legally responsible for claims, losses, or damages.

Idle Speed: The slowest speed at which a vessel can be operated while maintaining steerage control, generally to minimize wake.

Abandoned Vessel: A vessel left in dock space after the rental period without communication or agreement with AITL.

Clarenville Court: The legal jurisdiction for any disputes arising from this agreement.
